Family Court Transparency Reforms: What They Mean for You and How Our Family Law Solicitors Can Help

From 27 January 2025, all family courts in England and Wales are now subject to new reporting provisions, allowing for increased media access and greater transparency in family proceedings. This change follows a successful pilot and is described by the President of the Family Division, Sir Andrew McFarlane, as a “watershed moment for family justice”.

At Ludlow Lane Solicitors, we are proud to be recognised as trusted family law experts, helping clients navigate sensitive legal matters with confidence and care. We believe this reform highlights the importance of both public understanding and privacy protection within family law.

Greater Openness in Family Law Cases

Under the new scheme, journalists and accredited legal bloggers may now attend and report on family law cases across the country, provided a Transparency Order is in place. These orders protect the identity of those involved—particularly children—while allowing responsible reporting on how family courts make decisions.

This initiative, rolled out nationally after a two-year pilot in Cardiff, Leeds, and Carlisle, aims to build public trust in the family justice system. There have been no known breaches of confidentiality, and the courts remain committed to maintaining the anonymity of children and families.

What is a Transparency Order?

A Transparency Order outlines what can and cannot be reported when covering family court proceedings. It prevents the publication of:

  • Names of children, parents, or carers;
  • Addresses, schools, or medical facilities;
  • Photographs or identifying details;
  • Sensitive information such as abuse or health issues.

These protections typically remain in effect until the child involved turns 18. Importantly, judges still have the power to modify or deny reporting permissions where needed.

Why This Matters for Our Clients

As experienced family law solicitors, we understand how emotionally challenging legal proceedings can be—whether you’re facing divorce, child custody disputes, or care proceedings. Many clients worry about their personal lives being made public.

Here’s the reassurance: these new provisions are designed to ensure transparency without compromising your privacy.

At Ludlow Lane Solicitors, we:

  • Protect your identity and confidentiality;
  • Provide guidance if media presence is anticipated;
  • Ensure your rights are respected at every stage of your case.

Phased Implementation

The transparency measures are being introduced in stages to help courts and practitioners adjust:

  1. Public law cases – such as care proceedings and local authority involvement;
  2. Private law cases – including child arrangements, divorce, and financial disputes;
  3. Magistrates’ family court cases – expected to follow in due course.
