One of the principal areas of concern facing separating / divorcing couples is how family finances are to be divided.
Whilst there are a number of ways to settle financial matters, we detail the key methods below:
1. The parties can agree a division between themselves with the assistance of legal advice. The agreement will be drafted into a “Consent Order” and submitted to the court at the relevant time. There is no need for either party to attend court if this approach is adopted.
2. By recourse to the courts. If agreement cannot be reached, either party can apply to the courts to seek assistance in reaching financial settlement.
